Short-Term Disability in Ontario: Eligibility, Benefits and Common Denials
Short-term disability benefits are not a universal Ontario government benefit. They are usually provided through an employer-sponsored benefits plan, an insured group policy or, less commonly, an individual disability policy.
Eligibility therefore depends on the wording of the applicable plan. The definition of disability, waiting period, benefit amount, maximum benefit period, exclusions and proof requirements can differ significantly between policies.
What Is Short-Term Disability in Ontario?
Short-term disability (STD) is an income-replacement benefit that may be payable when an employee satisfies the plan’s definition of disability for a temporary period. Some plans are insured and adjudicated by an insurance company; others may be employer-funded or administered under different arrangements.
The plan booklet, policy and claim forms should be reviewed together. A general description from human resources may not contain every term that governs entitlement.
Who Qualifies for Short-Term Disability Benefits in Ontario?
An employee generally must be covered by the plan and provide evidence establishing that the applicable disability test is met. The precise test comes from the policy, not from a single province-wide definition.
Medical evidence is often most useful when it addresses functional restrictions and limitations, the treatment plan and how the medical condition affects the employee’s ability to perform the work required by the policy definition. A diagnosis, standing alone, may not answer those questions.
Physical and mental-health conditions can qualify where the evidence satisfies the plan. Depression, anxiety, post-traumatic stress disorder and other mental-health conditions are not automatically excluded simply because symptoms are not physically visible.
How Much Does Short-Term Disability Pay in Ontario?
The benefit amount and duration depend on the plan. Many plans replace a percentage of regular earnings up to a stated maximum and may impose a waiting or elimination period before payments begin.
The plan should be checked for:
- the percentage of income replaced and any weekly maximum;
- the waiting or elimination period;
- the maximum duration of STD benefits;
- offsets or deductions for other income;
- ongoing proof or treatment requirements; and
- the circumstances in which a claim may transition to long-term disability benefits.
Why Are Short-Term Disability Claims Denied in Ontario?
A claim can be denied for different reasons. The administrator or insurer may conclude that the medical evidence does not establish the policy’s disability test, that required forms or proof were not provided, that an exclusion applies or that a claim requirement was not met.
A denial letter should identify the reason for the decision and any internal review or appeal process. Employees should not assume that an internal appeal deadline is the only deadline that matters. Contractual rights and legal limitation periods can raise separate issues, so a denial should be reviewed promptly.
What Should You Do After an STD Denial in Ontario?
Obtain the denial letter, plan booklet or policy, claim forms and the medical material already submitted. Compare the stated reason for denial with the policy definition of disability and identify what evidence the decision-maker says is missing or insufficient.
Additional medical evidence may assist where it directly addresses the disputed functional restrictions or policy test. In other cases, the dispute may concern interpretation of the policy, an exclusion, procedural issues or the relationship between disability benefits and the employee’s workplace rights.
