CPP Disability vs. Long-Term Disability (LTD) in Ontario: How the Benefits Work Together
An employee who cannot work because of illness or injury may qualify for both Canada Pension Plan (CPP) disability benefits and long-term disability (LTD) benefits under a private insurance policy. The two programs are separate, use different legal tests, and often interact through offset and repayment provisions in the LTD policy.
That interaction becomes especially important when CPP disability is approved after LTD benefits have already been paid, or when an insurer ends LTD benefits despite a CPP approval.
What Are CPP Disability Benefits in Ontario?
CPP disability is a federal benefit for eligible CPP contributors who have a severe and prolonged disability.
For CPP purposes, a disability is considered severe when it usually or always prevents the person from doing substantially gainful work. It is considered prolonged when it is long-term and of indefinite duration or is likely to result in death.
A claimant must make a separate application to Service Canada for CPP disability. Receiving LTD benefits does not automatically create a CPP disability claim, and approval under one program does not determine entitlement under the other.
What Are Private LTD Benefits in Ontario?
LTD benefits are contractual. The insurer’s obligations depend on the wording of the policy or plan and the medical and vocational evidence supporting the claim.
Many group LTD policies use an “own occupation” test during an initial period, often 24 months, and then change to an “any occupation” test. The precise wording varies. An employee may therefore qualify at one stage and face a new eligibility assessment later.
A CPP disability approval can be important evidence because it reflects a federal finding of serious work incapacity. It does not, however, bind the LTD insurer if the policy uses a different test. Conversely, LTD approval does not guarantee CPP approval.
Can You Receive CPP Disability and LTD at the Same Time in Ontario?
Yes. But many LTD policies contain an offset provision allowing the insurer to deduct specified sources of other disability income, including CPP disability benefits, from the LTD amount otherwise payable.
For example, if the LTD policy provides a $3,000 monthly benefit and the policy permits a $1,000 CPP disability offset, the insurer may pay $2,000 while CPP pays $1,000. The actual calculation depends on the policy, including what sources of income can be deducted and whether any indexing or family benefits are treated separately.
Do not assume an insurer’s calculation is correct. Ask for the calculation in writing and compare it with the policy and the payment history.
What Happens if CPP Disability Is Approved Retroactively in Ontario?
CPP disability claims may be approved with retroactive payments for earlier months. If the LTD insurer paid benefits for the same period and the policy permits a CPP offset, the insurer may claim that it overpaid LTD and demand repayment.
Before using a retroactive CPP payment, review the LTD policy, any reimbursement agreement and the insurer’s calculation. The dates, gross and net amounts, tax treatment and specific benefits being offset can matter.
Some LTD policies also require the insured to apply for CPP disability, pursue an appeal, or permit an estimated offset in defined circumstances. Those rights are not universal; the wording of the policy controls.
What if the LTD Insurer Cuts Off Benefits in Ontario?
A CPP approval does not prevent an LTD insurer from terminating benefits, but it can be important evidence when the insurer says you are capable of returning to work. The termination letter, policy definition of disability, medical evidence, functional restrictions, vocational evidence and CPP decision should be reviewed together.
Limitation periods can apply to LTD claims. Do not assume an internal insurer appeal stops a legal limitation period.
